Learned counsel Mr. Mohit Deshmukh, for the appellants along with appellants/claimants and learned counsel Mr. Mundada, for the respondent No. 1 are present before panel. The representative of the respondent No. 1 is present online. They tender on record terms of compromise. Same is taken on record and marked 'X' for identification.

We have ascertained the identification of the parties with the assistance of their learned counsel.

Parties before the panel seek leave to dispose of first appeal in terms of compromise.

As per the terms of settlement Exhibit 'X', the respondent

2 fa 144.21.odt No. 1/Insurance company shall deposit an additional amount of Rs. 10,00,000/- (Rs. Ten Lakhs only) towards full and final settlement before the M.A.C.T., Aurangabad within a period of six (06) weeks from today. The same shall be treated as an undertaking.

On depositing the amount as agreed between the parties, the appellant No. 1 shall be disbursed an amount of Rs. 4,00,000/- (Rs. Four Lakh only). The appellant Nos. 4 and 5 shall be disbursed an amount of Rs. 2,00,000/- (Rs. Two Lakhs only) each. Balance amount of Rs. 2,00,000/- (Rs. Two Lakhs only) shall be invested equally in any nationalized bank in the name of appellant Nos. 2 and 3 till they attain age of majority. On attaining age of majority, the amount invested along with accrued interest shall be disbursed to the appellant Nos. 2 and 3. 6.

The first appeal stands disposed of in terms of settlement Exhibit 'X' and the minutes of the order passed today. 7.

The court fees be refunded as per rules.

Award be drawn up accordingly.
