I have heard learned counsel for the applicant/insurer and learned counsel for respondent nos.1 and 2/original claimants. There is delay of 43 days in preferring the appeal. Learned counsel appearing for respondents/original claimants has no objection, if the delay is condoned. 3.

In view of the same and for the reasons stated in the application, civil application is allowed in terms of prayer clause 'B' and disposed of accordingly.

In first appeal, issue notice of final disposal to the respondents, returnable 3.12.2020. Learned counsel Mr. Gandhi waives notice for respondent nos. 1 and 2. 5.
