Heard learned counsel for the applicant - insurance company and learned counsel representing the respondentsclaimants. Respondent No.3 reported to be not found on given address. It is pointed out that before Tribunal also respondent No.3 was absent and case proceeded ex-parte against him.

On due consideration of submissions advanced in the light of unchallenged and uncontroverted pleadings made in the application assigning cause for condonation of delay, the application is allowed. The delay is condoned. The appeal be registered.
