The petitioner, claiming to be a Member/Director of the Maharashtra State Handloom Co-operative Federation Ltd., Mumbai, ("MAHATEX"), has filed this petition for challenging the delegation of the additional charge of the Administrative Officer of MAHATEX to the Under Secretary, Co-operation, Textiles and Marketing Department of the State of Maharashtra. 2.

After briefly hearing the learned Advocate for the petitioner, we called upon him, to disclose his locus in filing this petition on

9566.22wp (2) behalf of MAHATEX. He has stated that, he is the Director of MAHATEX.

The learned A.G.P. points out that, his term as a Director is already concluded, to which, the learned Advocate for the petitioner submits that, he is still a Member of MAHATEX. When called upon to disclose, as to whether he is authorized by MAHATEX to represent the organization and to file this petition on behalf of MAHATEX, he submits that, there is no resolution passed and there is no authority delegated to him to file this petition.

In view of the above, this petition is filed by an authority, which does not have the competency to represent MAHATEX, by preferring this petition on behalf of MAHATEX. 5.

This petition is, therefore, dismissed.
