Though the matter was fixed to 10/06/2024 by consent, but the learned counsel for respondent pointed out that it was fixed only to confirm whether the original proceeding is still going on. However, to curb the infructuous matters, the office was directed to ascertain whether such matters are pending by checking it through the concerned courts. The office has already placed on record copy of order dated 10/04/2023 passed by the learned CJSD, Rahata, District : Ahemdnagar obtained from the official website. The same indicates that the original suit i.e. RCS No.41 of 2020 has already

2 26 cra 69-22 been withdrawn by the plaintiff Nos.1 to 3 by filing pursis Exhibit52. As such, the present civil revision application which is in respect of rejection of Exhibit-45 in aforesaid suit i.e. the application for rejection of the plaint, has already become infructuous.
