Heard. Pending civil suit between complainant and applicants, who are near relatives, several complaints and cross-complaints were filed by them against each others. Herein Crime No.02/2021 was registered on first information report lodged by cousin of the applicants under section 395 of the Indian Penal Code. Primary evaluation of the first information report unerringly shows that on the same set of allegations Crime No.201 of 2020 was registered against the applicants. In the said crime (Crime No.201 of 2020) applicants were granted anticipatory bail vide order dated 12th November, 2020. Therefore, this being second First Information Report, in my view, it was not maintainable.

Be that as it may, in view of the facts stated above, custodial interrogation of the applicants is out of question.

The application is therefore granted. In the event of arrest of the applicants in respect of Crime No.02 of 2021, registered with Yusuf Wadgaon Police Station, Dist.Beed for the offences punishable under sections 395 of the Indian Penal Code, the applicants shall be released on bail on executing bond in the sum of Rs.10,000/- [Rupees Ten Thousand] each with one or more sureties in like amount.
