PER COURT :- Present Criminal Application is filed by the Applicant for his release on regular bail, in connection with CR No.3040/2015 registered with Hingoli City Police Station, District - Hingoli for the offences punishable under Section/s. 7, 13(1)(d) read with 13/2 of the Prevention of Corruption Act, 1988.
[2] Heard Mr. P.R. Nangre, Advocate h/for Mr. S.S. Wagh, Advocate for the Applicant and Mrs. S.G. Chincholkar, Additional Public Prosecutor for the State of Maharashtra.
[3] The applicant was arrested in view of trap that was led by the Anti Corruption Bureau, Hingoli, District - Hingoli on 7th April, 2015. According to the First Information Report on the day of trap, the applicant being the public servant was found to be accepting Rs.3000/- from Smt. Ratnprabha Bhagwanrao Gadekar.
[4] The applicant is arrested on 7th April, 2015 and since then he is in jail. Looking to the fact that, post trap panchnama is also executed, further custodial presence of present applicant is not at all warranted. Hence, I pass the following order :-
ORDER
(i) Criminal Application is allowed.
(ii) Applicant - Shyam Dattarao Parde shall be released on regular bail on his executing PR Bond of Rs.25,000/- (Rs. Twenty Five Thousand only.) with one solvent surety in the like amount, in connection with CR No.3040/2015 registered with Hingoli City Police Station, District - Hingoli for the offences punishable under Section/s. 7, 13(1)(d) read with 13/2 of the Prevention of Corruption Act, 1988. (iii) The Applicant shall attend Hingoli City Police Station, District - Hingoli once in a week, preferably on every Sunday and shall remain present in the Police Station in between 3.00 to 5.00 p.m.
(iv) Bail before trial court.
(v) Criminal Application is allowed and same is disposed of accordingly.
