IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 6428 OF 2004 Shaikh Chand s/o. Babu Sahab ..

Petitioner

Versus

The State of Maharashtra & Ors.

..

Respondents Mr. V.P. Golewar, Advocate for the petitioner. Mrs.S.S. Raut, A.G.P. for respondent/State.

CORAM : A.V.NIRGUDE & V.K.JADHAV, JJ.

DATED :

13.10.2015 P.C. :- 1.

The petitioner sought appointment as an "Assistant Draftsman" in the office of respondent No.4, as per order dated 28th June, 2004. The petitioner was not allowed to join as "Assistant Draftsman". It was told to him that the post was already filled up by way of promotion. At interim stage, the petitioner was asked to take up post of "Jr. Clerk". Accordingly, the petitioner joined the duty as a "Junior Clerk" in the office of respondent No.4. Since then almost 12 years have passed. We are certain that the petitioner had made requests to the Department to appoint him as an "Assistant Draftsman", since he had educational qualification for such post. If the petitioner is not yet considered for

( 2 ) wp6428.04 such post, he may still make representation to his superior officer and the same should be considered sympathetically.

2.

With above directions, the writ petition stands disposed of.
