IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD CONTEMPT PETITION NO. 562 OF 2016 IN WRIT PETITION NO. 11564 OF 2015 Prakash Motising Bassi and another .. Petitioners
Versus
The State of Maharashtra and others .. Respondents Shri Anandsing Bayas, Advocate for Petitioners. Mrs. A. V. Gondhalekar, Addl.G.P. for Respondent Nos. 2 to 5. CORAM : S. V. GANGAPURWALA AND K. L. WADANE, JJ.
DATE : 18TH NOVEMBER, 2016.
PER COURT :
.
The present contempt petition is filed on the ground that the order passed by this Court on 02nd December, 2015 in Writ Petition No. 11564 of 2015 is not complied that is caste claim is not decided within stipulated period as directed by this Court. 2.
We have heard Mr. Bayas, the learned counsel for the petitioner and the learned Additional Government Pleader for respondents. In the affidavit explanation has been given by the members of the Committee for not being in position to decide the proceedings within stipulated period. The matter was required
2 cp 562.16 to be referred to the Vigilance Cell twice.
3.
This Court would invoke its contempt jurisdiction, if it finds that the authority has exhibited supine indifference to the orders passed by this Court. The explanation is forthcoming, though according to Mr. Bayas, the learned counsel, the manner in which the proceedings are decided is improper and the order is illegal. The same cannot be considered in the contempt proceedings.
4.
The petitioner has remedy to challenge the same in appropriate proceedings. As the order of this Court is complied with, though belatedly, the contempt stands purged. The contempt petition is disposed of. No costs.
