The learned counsel for the petitioner/plaintiff submits that respondent No. 2/defendant No. 2 has appeared before the Trial Court and on the address given in the plaint, notice is served in the trial Court proceeding. The learned counsel further submits that office note shows that respondent No. 2 is not residing on the given address and respondent No. 2 is avoiding the service and he therefore, prays for serving the respondent through paper publication. The learned counsel submits that the last known address of respondent no. 2 is Waluj Aurangabad. 2.

In view of the same and for the reasons stated in the Civil Application No. 4280/2024, the application is allowed in terms of prayer clause 'B', which is as under :- "B.

Hon'ble Court may kindly passed order in respect of issuing notice of this Writ Petition to Non Applicant No. 2 by way of Paper Publication in Daily News Paper Divya Marathi, Aurangabad Edition in the interest of justice and oblige." 3.
