The learned Advocate for the applicants submits that the earning family member was lost in the accident and that appellant did not have money for the education of the children and to take care of old parents of the deceased, so also to file the appeal in time. 3.

In view of the submissions of the learned Advocate and the reasons stated in the application, the delay of 269 days in filing the appeal stands condoned. The application is allowed and disposed of. 4.

The appeal is admitted.
