Heard the learned counsel for the applicants and the learned APP for the respondent-State.

The applicants seek bail in Crime No.807 of 2023, registered with Akole Police Station, District Ahmednagar, for the offences punishable under Section 302, 452, 143, 144, 147, 148, 149 of the IPC.

It is the case of the prosecution that the assailants assaulted the deceased with sticks in the field. The cousin brother of the deceased witnessed the incident and informed the first informant. The deceased was taken to the hospital. However, at the initial stage the accidental case under Section
174 of Cr.P.C. was registered. The allegations reveal that immediately after the incident, the names of the assailants were not disclosed. However, the reason best known to the first informant why he did not name them at the first instance. Since the names of the applicants disclosed subsequent to lodging the accidental case, it would be unsafe to keep the applicant behind the bar. The weapon from one of the accused has been recovered. Their detention would serve no purpose. However, to safeguard the interest of the witnesses, certain conditions may be imposed. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant Nos.1 RAVINDRA SURYABHAN SONAWANE, 2. SOMNATH GABAJI MORE, 3.
VALMIK @ BAPPU DILIP ABHANG and 4. SAGAR MANGESH DIVE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) each with one solvent surety of like amount each on the following conditions : (a) The applicants shall not enter the village for three months from the date of their release.
(b) They shall attend the trial on each and every date.
