We have considered the submissions of the learned Advocate Mr. Thombre on behalf of the Petitioners, the learned Government Pleader on behalf of the Respondent/State and the learned Advocate on behalf of Respondent No. 5 Zilla Parishad. The inter-district transfer policy is now

( 2 ) revised vide Government Resolution dated 23.05.2023. Any person, who desires inter-district transfer, has to tender an online Application. As per the terms of the said Government Resolution, the Applications have to be considered and if any candidate fulfills the requirements of the said Government Resolution and if there are corresponding vacancies in the district in which a transfer is sought, appropriate orders have to be passed by the Authorities.

In view of the above, there could not be a Writ of Mandamus to transfer the Petitioners from a particular district to another district, without letting the Authorities deal with such Applications under the said Government Resolution.

In view of the above, the learned Advocate for the Petitioners submit that the Petitioners would tender online Applications. Needless to state, if such Applications are tendered, the same shall be considered in the light of the Government Resolution dated 23.05.2023, during the transfer season for the next academic year, as and when portal for inter-district transfer is opened.
