Instant application is for condonation of 119 days delay caused in filing appeal against judgment and order passed by learned Special Judge (Court No.11), Aurangabad in Special Case (ACB) No.14 of 2014 dated 14-05-2024 acquitting present respondents from charge under Section 8 of the Prevention of Corruption Act.

It is submitted that due to administrative approval, leave to file appeal could not be filed in stipulated period. That, delay
{2} CR APPLICATION NO. 1282 OF 2025 of 119 days has occasioned and it is for above reason and it is unintentional. Learned APP undertakes to workout the Application for Leave to file Appeal with due diligence. 3.
Learned counsel for original accused has formal objection about no plausible reason for condonation of delay. 4.
Considering the above submissions and for the reasons stated in the application and in the interest of justice, delay of 119 days, which is attributed to administrative sanction, is required to be condoned. Therefore, application for condonation of delay is allowed. Delay of 119 days caused in filing application for leave to file appeal is condoned. Application for leave to file appeal by State be registered.
