This is an application for condonation of delay. Record shows that this Court had issued notice to the respondent to answer the said application by order dated 16-04-2025. On 09-07-2025, this Court had noted that inspite of service, as none appeared, matter was posted for next date and it was specifically observed that if none appears for the respondent on the given date, matter will proceed exparte. 2.

Thereafter, again similar order was passed by this Court on 25-07-2025. Today also when the matter was called out twice in the morning session and kept back in the afternoon session, at such time, none appeared for the respondent to answer the application for condonation of delay. Resultantly, for the reasons mentioned in the application, delay stands condoned and application is allowed and disposed of accordingly.

Application for Leave to Appeal by Private Party be registered. After registration, issue notice to the respondent, returnable within four weeks thereafter. ( ABHAY S. WAGHWASE, J. ) SPT
