The appellant claiming to be the trustees of a trust to be filed the suit to protect its interest. Both the courts below have concurrently dismissed the suit. It appears that by virtue of the resolution passed by the board of trustees in a meeting dated 28 October 2021 resolving that the property that was purchased by the trust continues to be in its possession and the dispute was pertaining to some additional portion of 39 gunthas, the board of trustees have resolved to authorise the appellants to withdraw the second appeal. A copy of resolution is taken on record and marked ' X' for the purpose of identification.
