Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in Crime No.0311 of 2022 registered with Bazar Peth Police Station, Bhusawal, District Jalgaon, for the ofence punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code. 3.

The applicant, the deceased and the co-accused were captured in CCTV footage in a Bar. As per the prosecution case, thereafter they left together, since then the deceased was missing. It was transpired in the investigation that suddenly co-accused strangulated the deceased. It has been alleged against the applicant that he was throughts with the

946-BA-633-23.odt co-accused; but he did not disclose the incident. He has been arraigned as an accused on the extra judicial confession of the co-accused. It is weak piece of evidence. No weapon is recovered from him. In view of the role attributed to the applicant and the evidence collected in the crime, the Court is of the view that the applicant deserves bail. Hence, the following order:- (i) The application is allowed.

(ii) Applicant Sagar Dagdu Patil be released on bail on furnishing P. B. and S.B. of Rs. 50,000/-, with one solvent surety of the like amount, in Crime No.0311 of 2022 registered with Bazar Peth Police Station, Bhusawal, Taluka Bhusawal, District Jalgaon, for the ofence punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code, on the conditions that;

(a) He shall not tamper with the prosecution witnesses.

(b) He shall attend the trial on each and every efective date.
