Heard the learned counsel for the applicants and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in Crime No.119 of 2022 registered with Kundalwadi Police Station, Taluka Biloli, District Nanded, for the ofence punishable under Sections 302, 143, 147, 148 and 201 read with Section 149 of the Indian Penal Code.

The prosecution had a case that one Balaji Dhage was threatened the deceased to kill. Therefore, his mother was asking for help to the Tantamukti President of village and

944-BA-631-23.odt others. The incident was allegedly happened in front of house of Balaji Dhage. The prosecution has cited some eyewitnesses, their statements have been recorded belatedly. The role attributed to the applicant is limited. The weapons have been recovered from the co-accused. Considering the role attributed to the applicant, he deserves bail. Hence, the following order:- (i) The application is allowed.

(ii) Applicant Ravi Dhondiba Dhage be released on bail on furnishing P. B. and S.B. of Rs. 50,000/-, with one solvent surety of the like amount, in Crime No.119 of 2022 registered with Kundalwadi Police Station, Taluka Biloli, District Nanded, for the ofence punishable under Sections 302, 143, 147, 148 and 201 read with Section 149 of the Indian Penal Code, on the conditions that; (a) He shall not contact any other witnesses till conclusion of the trial.

(b) He shall attend the trial on each and every efective date.
