Heard the learned counsel for the applicant and the learned APP for the State.

It has been alleged against the applicant that he has provided the car to the main accused and taken to the place as directed by the main accused. Except this, there are no allegations.

Learned APP opposed the application contending that the offence is serious. The victim flee away from house with huge amount of Rs.5,00,000/- and more. He fairly conceded that the alleged car is seized and returned on suprutnama to the registered owner of the car.

Considering the allegations levelled against the applicant, the prosecution has no strong ground to have the custodial interrogation of the applicant. The applicant is a young boy of 23 years old and there are no antecedents to his discredit. Considering the entire circumstances of the case, this is a fit case to exercise the discretion under Section 438 of the Cr.P.C. in favour of the applicant. Hence, the following order :

O R D E R

(i) The application is allowed.

(ii) The interim protection granted to the applicant Amit Sanjay Jadhav by the order dated 25.04.2022 stands confirmed on the same terms and conditions.
