The learned standing counsel for the Union of India appears for respondent nos. 1 to 3 and the learned AGP appears on behalf of respondent no. 4.

The petitioner has put forth prayer clause 'C' as under :- C) By appropriate writ order or direction the respondent No. 2 appellate authority may kindly be directed to heard and decide the appeal filed by the petitioner dated 16.11.2021 [Exhibit "F"] within some stipulated period of time.

The learned standing counsel submits that respondent no. 2 would decide the pending appeal filed by the petitioner within 90 days, provided the petitioner complies with the procedure and especially Rule 121 (2), Schedule IV of the Explosive Rules, 2008.

In view of the above, this petition is disposed off. 5.

We expect, respondent no. 2 to decide the pending appeal preferred by the petitioner, as early as possible and preferably, on or before 30th November, 2022, subject to procedural compliances by the petitioner.
