DATED : 18 th June, 2015 PER COURT :- 1] Heard Shri S.S.Thombare, learned counsel for applicant and Shri V.H.Dighe, learned Additional Public Prosecutor for the respondent/State 2] The present application is for anticipatory bail since he apprehends his arrest in connection with Crime No. 80 of 2015, registered at Osmanabad (City) police station, for the offence punishable under Section 409 of the Indian Penal Code.

3] From the first information report, it is clear that in spite of the direction given to the present applicant, he failed to lodge the first information report and on verification it was found that 301 bags of pulses were found to be less. 4] There is no dispute that the applicant is already suspended from service and he has no control over any of the documents or the functioning of the Maharashtra State Ware House, Osmanabad.

5] Learned Additional Public Prosecutor Shri Dighe for the State submitted that the investigating officer wants to interrogate the applicant. That can be taken care of by

crap2064.15 directing the applicant to attend the police station twice a week till the charge sheet is filed. That leads me to pass the following order.

O R D E R

(i) Application is allowed.

(ii) In the event of arrest, in connection with Crime No. 80 of 2015, registered at Osmanabad (City) police station, for the offence punishable under Section 409 of the Indian Penal Code, the applicant-Nilu Ramji Bele be released on adinterim anticipatory bail on he executing P.R. bond in the sum of Rs.5,000/- with one solvent surety of like amount. (iii) The applicant-Nilu shall attend police station twice a week preferably on every Monday and Wednesday initially for a period of one month and thereafter the applicant shall attend police station once a week on every Sunday till charge sheet is filed.

(iv) Application is disposed of.
