Maharashtra Pashuvaidyak Padvidhar Ass. v. The State Of Mah.
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD 903 WRIT PETITION NO. 6483 OF 2004 MAHARASHTRA PASHUVAIDYAK PADVIDHAR ASSOCIATION, AURANGABAD, THROUGH ITS PRESINDENT
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioner : Mr. B E Gaikwad (Absent) AGP for Respondent Nos. 1 to 5 : Mr. D. B. Bhange Advocate for Respondent Nos. 6 and 7 : Mr. V. R Sonwalkar .....
CORAM : A.V. NIRGUDE & V.K. JADHAV, JJ.
Dated: October 08, 2015 .....
PER COURT :- 1.
None for the petitioner.
2.
It is found that this petition is filed for quashing and setting aside the advertisement issued in the year 2004 seeking recruitment to the post of Veterinary Officer etc. Though, for some time, the order of status-quo was passed in favour of the petitioner, later on, it was withdrawn and the petition was admitted in the year 2005. Since last 11 years the petitioner is not protected. This means that the advertisement must have taken its effect and the petitioner would not be able to pursue the remedy against such advertisement now. In view of the above, in our view, the petition is now rendered infructuous and the same is disposed of accordingly. Rule discharged.
