This application is for transfer of HMP No. 27 of 2023 pending before the learned Civil Judge, Senior Division, Bhoom to the learned Family Court, Latur.

The learned Advocate for the applicant submits that the distance between two places is 125 kms. The applicant-wife is staying with her parents. There is no one to accompany her.

The application is vehemently opposed by the learned Advocate for the respondent. He submits that the

10-MCA-100-24 proceeding is filed in the Court having jurisdiction. The respondent-husband is ready to pay traveling expenses. Considering the above, following order :

ORDER

i.

The Miscellaneous Civil Application is allowed in terms of prayer clause "B".

ii.

After transfer, the applicant-wife shall not seek any unnecessary adjournments. In case, the Court comes to conclusion that the applicant-wife is seeking unnecessary adjournments, the Court shall pass appropriate order compensating the respondent-husband in case he personally attends the court on such date.

iii.

The Family Court shall try to conclude proceedings as early as possible and preferably within 18 months from today.

iv.

The Miscellaneous Civil Application stands disposed off.
