I have heard Mr. Gangakhedkar, the learned counsel for the appellants and Mr. Dawalkar, the learned counsel for respondents.

Learned counsels have canvassed the submissions on merits.

It is also submitted that, the matter is now ready for evidence. The amount awarded as interim compensation is already deposited by the appellants herein with the Commissioner, Workmen's Compensation. Interest of justice would be subserved by passing the following order -

ORDER

I] The amount deposited by the appellants pursuant to the impugned interim order shall be kept with the Commissioner, Workmen's Compensation till disposal of the claim petition.

II] The Commissioner, Workmen's Compensation shall decide the application for compensation filed by the respondents / Claimants expeditiously and preferably within six (6) months from today.

III] The Commissioner Workmen's Compensation shall allow the withdrawal of the amount deposited by the appellant after the final judgment is passed in the claim petition to the parties in whose favor the claim petition is decided.

First appeal is accordingly partly allowed.
