We have heard learned Counsel for the petitioner. 2.

The learned Counsel for the institution submits that the respondent No. 3 is ready to appoint petitioner on compassionate ground. 3.

In case, the post is vacant and the petitioner is otherwise eligible to be appointed on compassionate ground, then the respondent No. 3 can appoint the petitioner on compassionate ground and submit the proposal for approval. The said ban would not apply to the appointment on compassionate ground. Of course, if the appointment on compassionate ground is within the permissible limits.
