Writ Petition No.5673/2024 :: 2 ::

Backward Bahujan Welfare, Maharashtra State, Pune to verify the proposal dated 27/3/2024 submitted by the Headmaster of petitioner's school by considering that petitioner is also entitled to the benefits of ACPS and Respondent No.4 has rightly extended the said benefits in favour of petitioner, by this Hon'ble Court, by issuing necessary writ or directions as the case may be. 3.

The petitioner is a non-teaching employee, working as Cook in Shri Basneshwar Ashram School, Burhannagar, Taluka and District Ahmednagar. This Court, in Writ Petition No.2358/2013, has declared the teaching and non-teaching Group 'D' and Group 'C' employees of aided private schools in the State of Maharashtra to be entitled to the A.C.P.S. benefits. The petitioner's employer forwarded the proposal for grant of first benefit thereof. The respondent No.3 has, however, not accepted the proposal and refused to verify the same. We, therefore, allow the Writ Petition in terms of prayer clause (D) with further direction that the respondent No.3 shall decide the proposal on its own merits.
