This is an application for restoration of First Appeal No.66/2004. First Appeal No.668/2004 came to be dismissed for want of prosecution vide order dated 07/06/2023. According to the appellants, they have filed this appeal for seeking enhancement of compensation on account of death of husband of applicant No.1, by condoning delay of 609 days for preferring this application.

The appeal preferred by applicants came to be dismissed since their earlier Advocate had given notice of discharge and therefore, nobody had appeared on their behalf. 3.

For the reasons stated in the application, the same is allowed. Delay is condoned. First Appeal No.668/2004 be restored to its original file and list the same for final hearing 16/01/2026. CIVIL APPLICATION NO.5062/2025 4.

By this application, the applicants are seeking deletion of name of applicant No.5/original appellant No.5 in appeal. 5.

According to the learned Advocate for applicants, applicant No.5 is expired on 08/05/2018.

In view of the above, permission to delete name of applicant No.5 is granted.
