Learned counsel for applicants states that, he is not pressing this application at this stage. He stated that, police had not registered FIR and only pursuant to the order passed U/Sec. 156(3) of the Criminal Procedure Code, the offence has been registered.

Learned counsel for the applicants seeks permission to withdraw this application with liberty to approach this Court if charge sheet is filed and to challenge the charge sheet. 3.

In view of the above, we are inclined to grant said liberty. Hence following order.

The criminal application is allowed to be withdrawn. The applicants are at liberty to approach this Court for quashing of the charge sheet, if charge sheet is filed. It is made clear that all the contentions of first informant as well as applicants are specifically kept open at this stage. The criminal application is disposed of.
