Heard the learned Advocate for the Applicant and the learned APP for the Respondents - State.

The Applicant is apprehending arrest at the hands of Basamba Police Station, District Hingoli, in Crime No.55/2025, for the offence punishable under Section 117(2), 3(5), 351(2), 351(3) and Section 352 of the Bharatiya Nyaya Sanhita, 2023, and therefore, he has filed this Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

The above-referred Crime is registered on the report lodged by the Applicant's uncle that, in the morning of 24/02/2025, when he had gone to ask the money from one Golu Limbewar in connection with providing the horse in the marriage, the Applicant and

942-ABA-599-2025.odt the Applicant's father came near the Informant. The Applicant's father picked quarrel with the Informant and the Applicant assaulted the Informant with a stick. Due to the chaos, the people gathered and the Applicant and his father left the spot.

The Informant is an uncle of the Applicant. The Applicant and the Co-accused are named in the FIR. The father of the Applicant is granted protection by the Sessions Court. This Court by an interim order dated 23/04/2025, after hearing both the sides and on going through the papers, including the injury certificate by considering that, the parties were relatives and the injury though grievous was a fracture of finger, protected the Applicant. It is nobody's case that, the Applicant has misused the liberty. Nothing new is revealed during the investigation. Hence, in my view, the interim protection deserves to be confirmed. Hence, the following order :

ORDER

[I] Interim Order dated 23/04/2025 granted by this Court is confirmed.

[II] The Applicant shall attend the concerned Police Station as and when called by the Investigating OfÏcer.
