Bipin Chhaburao Patole And Others v. The State Of Maharashtra And Others
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD REVIEW APPLICATION NO.106 OF 2017 (Bipin Chhaburao Patole and others Vs. The State of Maharashtra and others) IN WRIT PETITION NO.9175 OF 2016 Mr.V.P.Latange, Advocate for the applicant.
Mr.S.P.Deshmukh, AGP for respondent Nos. 1 to 3. ( CORAM : Ravindra V.Ghuge, J.) DATE : 23/06/2017 PER COURT :
1.
Learned Advocate for the applicants submits that this Court has reproduced the observations of the Industrial Court in paragraph Nos. 18, 19 and 20 of the impugned judgment under paragraph No.8 of the order dated 09/03/2017 passed in WP No.9175/2016. He submits that all the adverse observations of the Industrial Court in paragraph Nos. 18, 19 and 20 of the impugned judgment cannot be sustained as they are against the record.
2.
In my view, if the observations of the Industrial Court were against the record, the petitioners could have taken steps for seeking expunging of the said adverse remarks before the Industrial Court. However, that has not been done.

3.
In the light of the above, no error on the face of the order dated 09/03/2017 can be pointed out by the review applicant. 4.
Considering the above, this application is disposed of by keeping all contentions of the applicants open to be canvassed while hearing the writ petition finally.
5.
The applicants are at liberty to make a request for early hearing of the petition after 3 months.
