Aggrieved by the order dated 15.03.2019 passed by the Maharashtra Administrative Tribunal at Aurangabad in Original Application Stamp No.503 of 2019, the petitioner has filed this petition.

We have briefly heard the learned counsel for the petitioner and the learned AGP. The learned Tribunal has disposed off the Original Application on the ground that the applicant did not have any grievance to be voiced before the learned Tribunal with regard to his pensionary benefits. 3.

The learned Advocate for the petitioner submits that, now the widow is equipped with sufficient papers, so

4460.19WP as to lay a claim for pensionary benefits in accordance with Rule 30 of the Maharashtra Civil Services [Pension] Rules, 1982.

Considering the above and as the learned Tribunal has disposed off his Original Application with the observations that the deceased applicant had not made any claim and there was no order of rejection of his pensionary benefits, that this petition is disposed off by granting liberty to the petitioner to approach the Competent Authority with proper set of documents to be presented through the widow of the original applicant, for claiming pension and benefits, incidental and consequential thereto. The Authorities considering such application shall pass an appropriate order strictly in accordance with the law applicable within a period of four months from the date of filing of the application.
