Heard the learned counsel for the applicant and the learned A.P.P for respondent/state.

The applicant is seeking bail in Crime No. 1/2023 registered with Police Station Paranda, District Osmanabad for the offences punishable under Sections 354,, 3,1, 54061 of the Indian Penal Code and under section 8 and 12 of POCSO Act. 3.

Perused the charge sheet. The applicant was arrested in the month of January 2023. He has undergone the police custody. The charge sheet has been fled. Considering the allegations levelled against the applicant and the nature of the crime it would be unjustifable to keep the applicant behind bar.

ORDER

(i) The application is allowed.

(ii) Applicant Sachin Navnath Itape be released on bail on furnishing P. B. and S.B. of Rs. 540,000/- with one solvent surety of the like amount, in aforementioned crime registered with aforementioned police station, on the following conditions : (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall not contact the victim and other witnesses till the conclusion of the trial.
