The learned counsel for the applicants submits that, the parties have arrived at compromise in the Second Appeal No.375/2008 and, this application seeking restoration of the second appeal by condoning the delay may be allowed. 3.

Learned counsel for respondents has no objection if the delay is condoned and appeal is restored since the matter is amicably settled between the parties.
