Heard learned counsel for the applicant, appointed by the Legal Aid Cell. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0049/2021, registered at M.I.D.C. Police Station, Latur for the offence punishable under Section 302 of the Indian Penal Code. 2.
The applicant is alleged to have committed murder of his wife at his residence. It is he who himself approached the concerned Police Station to report the same. True, whatever he has reported may not be admissible as being hit

as a confession to police. There is a statement of the landlord Balaji Ghodke. It is in his statement that, both the deceased and the applicant herein were the only persons residing together in the house wherein the dead body was found pursuant to the information given by the applicant to the police. The police immediately went to his room to find the dead body and the weapon used in commission of the murder. This piece of material, coupled with the statement of the landlord is quite sufficient to indicate the applicant's role in the offence in question. The applicant, therefore, does not deserve to be enlarged on bail. The Bail Application is rejected.
