The petitioner is seeking direction to the respondents to prescribe the post of Sarpanch of village Ekghari, Tq. Himayatnagar, District Nanded to Scheduled Tribe category, male or female. The post has been prescribed for O.B.C. female category during the tenure 2015-2020. It is pointed out that the population of S.T. category in the village is 888 out of 1400, which constitute 63.43%. 2.

The learned A.G.P. appearing for the respondents 1 to 3 informs that the wherever it is noticed that population of S.T. category is more than 70%, the seat has been necessarily prescribed for S.T. category alone. Whereas in the case, where the population is less than 70% the seat has been rotated. It is informed that out of

wp4575.15 -27 members of village Panchayat, 4 seats are earmarked for S.T. category, 2 seats are earmarked for O.B.C. category and 1 seat is earmarked for open category. It is further pointed out that during the preceding election, the post of Sarpanch was prescribed for S.T. category, as such the same has been rotated. The post has been prescribed in favour of the O.B.C. woman category. It is also to be noted that election to the post of Sarpanch are scheduled to be held tomorrow. The petitioner has approached this Court belatedly. For the reasons recorded above, no interference is called for. The petition stands rejected.
