Applicant prays for condonation of delay of 301 days caused in lodging the second appeal. Reasons seeking condonation are assigned in paragraph Nos.3 and 4 of the application. 2.

Learned Advocate for the respondents opposes the application and seeks rejection as the reasons are unjustified. 3.

In the light of the above and in view of the explanation put forth by the applicant, delay of 301 days in lodging the second appeal is condoned subject to costs of Rs.3,000/- (Rs.Three thousand only). Learned Advocate for the respondents graciously submits that the khs/March 2015/7893-13 (d)

said amount be deposited with the Advocates' Bar Library, High Court, Bench at Aurangabad.

Civil application is therefore allowed. The applicant shall deposit costs of Rs.3,000/- (Rs. Three thousand only) with the Advocates' Bar Library, High Court, Bench at Aurangabad, within a period of 4 (four) weeks from today, failing which this order shall stand recalled and the civil application shall stand rejected. 5.
