Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for respondents. 2.

Amongst other submissions, one of the submissions of the learned counsel for the petitioner is that, the real sister of the petitioner namely Neha D/o Govind Baste had also applied for validity certificate. Her claim was invalidated. She filed Writ Petition No. 10329 of 2017. The Division Bench of this Court at Principal Seat at Bombay under judgment and order dated September 28, 2017 allowed the writ petition directing the Committee to issue validity.

The claim of the petitioner is negatived under the common

2 wp 6281.21 judgment dated 16.12.2020. The said common judgment was delivered in the case of petitioner and one Sachin Pandurang Baste. Said Sachin Baste filed Writ Petition No. 7648 of 2021 before this Court. This Court under order dated 20th October, 2021 allowed the writ petition directing the Committee to issue validity certificate.

In the light of the aforesaid judgments delivered by the Division Bench of this Court, we pass the following order. 5.

The respondent/scrutiny committee shall issue validity certificate to the petitioner of Mannervalur (Scheduled Tribe). The said validity certificate shall be subject to the decision that would be taken by the Committee in the proceedings reopened of the validity holders relied by the petitioner and other paternal relatives, who are directed to be issued with the validity certificate under the orders of this Court.

In the light of the above, the writ petition is disposed of. No costs.
