The learned counsel for the petitioner submits that validation proceeding in respect of the caste claim of the petitioner is pending with respondent No.2 since the year 1999. 2.

The petitioner is not being given the continuity of service nor salary is paid to the petitioner. The proposal for the approval is not considered.

The learned AGP accepts notice for all the respondents and upon instructions of respondent No.2 submitted that validation proceeding of caste claim of the petitioner is pending and the same would be decided within one month.

The petitioner shall appear before respondent No.2 Committee on 30th June, 2021. Respondent No.2 Committee shall thereafter decide the validation proceeding within one month. 5.

Respondent No.3 may not refuse to entertain proposal for the approval only on the ground that validation proceeding is pending. Respondent No.3 may take further course of action depending upon the Judgment that would be delivered by the Committee in the validation proceeding.

Writ Petition is disposed of. No costs.
