The applicant apprehends arrest in connection with FIR No.495 of 2023 registered with Supa Police Station, Dist. Ahmednagar, for the offences punishable under sections 307, 323, 506 read with 34 of the Indian Penal Code (For short, "IPC").

It is prosecution's case that on 30th November, 2023, the applicant along with co-accused assaulted the informant with iron rod with an intention to kill him.

It is contention of the learned counsel for the applicant that the matter is settled out of the Court. In the supplementary statement recorded of the wife of the first informant, she has stated that she has no complaint against the applicant, hence requested to allow the application.

It is the contention of the learned APP that the appropriate

I have heard both the learned counsel. Perused the F.I.R. and suplementary statement of Sujata Shelke, wife of the informant dated 27th June, 2024. In the said supplementary statement, she has stated that the matter is settled out of the Court and she had no complaint against the applicant. Considering these allegations, custodial interrogation of the applicant is not required and I pass the following order :-

ORDER

(i) The application is allowed.

(ii) In the event of arrest of the applicant in connection with FIR No.495 of 2023 registered with Supa Police Station, Dist. Ahmednagar, for the offences punishable under sections 307, 323, 506 read with 34 of the Indian Penal Code, the applicant be released on executing personal bond in the sum of Rs.15,000/- with one surety of the like amount, on the following conditions :- (a) the applicant shall attend the concerned police station as and when required by the Investigating Officer.
