Heard learned Counsel for the applicant and learned A.G.P. for the State.

Learned Counsel for the applicant submits that applicants No.2 and 3 are the original respondents No.4 and 5 before the reference Court and inadvertently, they have been shown as applicants No.2 and 3.

He submits that the reference Court has even allowed the reference application in terms of prayer made in the reference petition by the petitioner Uddhav Ashru Hinge and no share from the compensation was awarded to the original respondents No.4 and 5 therein. The respondents No.4 and 5 have not contested the reference petition in any manner.

In view of above and for the reasons stated in the application, the application is allowed in terms of prayer clause (B) and (C). 5.
