This Court under order dated 01st August, 2016 in Writ Petition No. 8160 of 2016 has directed the committee to decide the validation proceeding within one year. Same is not yet decided.

Unless the vigilance submits it's report, the petitioner has no role to play in validation proceeding. It is submitted that the validation proceeding is still pending. In light of that, we pass the following order :- (I) The petitioner is protected till decision is taken by the scrutiny committee in validation proceeding.

(III) The employer may take further course of action depending upon the judgment that would be delivered by the committee in the validation proceeding.
