Learned counsel for the appellant files on record the instructions, dated 11.06.2015, received by him from the appellant to the effect that he does not wish to proceed with the present appeal as the compromise has taken place between him and the respondent No.2-accused. The said instructions are taken on record and marked "X" for the purpose of identification.

The present appeal is preferred against the acquittal of the respondent No. 2 from the offence

criapl371-2015 punishable under section 138 of the Negotiable Instruments Act.

Since the proceeding is under section 138 of the Negotiable Instruments Act, withdrawal of the appeal is permitted.

The present criminal appeal is, therefore, allowed to be withdrawn. The arrest warrant issued against the respondent No. 2 be called back. The appeal accordingly stands disposed of.
