Heard learned counsel for the parties.

Although respondent purports to resist the application, however, he has not been able to seriously challenge veracity of the contents of the application accounting for condonation of deay. 3.

In the circumstances, delay stands condoned. Civil application stands allowed in terms of prayer clause (B) and disposed of. 4.
