Learned A.P.P. waives notice for the respondent­State.

The applicant, who has been convicted by the learned Sessions Judge, Osmanabad vide judgment and order dated 24/03/2015 passed in Sessions Case No.133 of 2014, for the offence punishable under section 326 of

2 Cr. Appln. 2128/2015 the Indian Penal Code and sentenced to suffer rigorous imprisonment for 3 years and to pay fine of Rs.1000/­, in default to suffer rigorous imprisonment for 15 days for the said offence, is praying for suspension of the substantive sentences during the pendency of the appeal and his release on bail.

Learned counsel for the applicant submits that fine amount is already deposited.

Considering the short term sentences awarded to the present applicant and finding that injuries were found on the person of the present applicant, the substantive sentences are hereby suspended.

The applicant be released on bail, upon his execution of P.R. bond in the sum of Rs.20,000/­ (Rs. Twenty Thousand) and also upon furnishing surety in the like amount.
