Heard the learned counsel for the applicant and the learned APP for the Respondent/State.

The applicant was granted bail in the year 2015. However, he remained absent. Hence, NBW was executed against him. The application for bail filed by the applicant was rejected, since he remained absent for a long time and delayed the trial.

In an application for bail, he submitted that he was in the State of Karnataka for sugarcane cutting and fell ill. Therefore, he could not attend the trial.

The applicant is from labour class and not serious about the trial. He is behind bar since 05.01.2023. The applicant is
ready to undertake to attend the trial on each and every date. If he would not attend the trial without justifiable reason, he would surrender himself before the Court.
5. In view of the facts of the case and undertaking, application deserves to be allowed. Hence, the following order:
O R D E R
(i) Bail Application is allowed.
(ii) Applicant GANESH PRALHAD BHALSHANKAR be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.10 of 2015, registered by Police Station Peth Beed, District Beed, for the offences punishable under Sections 394, 395, 397, 511 of the IPC, on the following condition :
(a) The applicant shall furnish an undertaking before the Trial Court that he shall attend the trial on each and every date without any justifiable reason. If he would not satisfy the Trial Court that he was absent for the justifiable reason and remained absent for
two consecutive dates, he shall surrender before the Court.
