It appears to be a case of scuffle between the informant and his family members on one hand and the applicants and their family members on the other. Although the informant appears to have suffered grievous injury at his left temporal region, the record indicates he was discharged from the hospital same day. There is prima facie nothing to substantiate the said injury was grievous in nature. On the contrary, there are papers placed on record indicating the applicant to have suffered head injury which appears to have been caused due to a sharp weapon.

Considering these facts, order dated 11th April, 2023 granting the applicants interim anticipatory bail is hereby made absolute. The applicants shall appear before the investigating officer, as and when required for the investigating purpose. They shall not tamper with the prosecution evidence. ( R.G. AVACHAT, J. ) SSD 2 / 2
