The learned counsel appearing for the appellant submits that the appellant no.1 - Shakil Haji Chhotu Bagwan has filed affidavit and prayed for permission to withdraw the appeal on ground that the cause in the appeal has been settled between the appellant and the respondent before the executing Court in Regular Darkhast no. 71/2012.

Since the dispute between the appellant and respondent are amicably settled before the executing Court in Regular Darkhast no. 71/2012. Therefore, the present appeal is dismissed as withdrawn. No order as to costs.
