This is an application for suspension of sentence and granting bail to the applicant.

By the judgment dated 15th May, 2023 passed in Regular Criminal Case No.16 of 2020, the learned Judicial Magistrate First Class, Mukhed, District Nanded, convicted the applicant for the offence punishable under Section 354 of the Indian Penal Code and sentenced him to suffer rigorous imprisonment for one year and to pay fine of Rs.5,000/-. The said conviction is confirmed by the judgment dated 5th April, 2024 delivered in Criminal Appeal No.30 of 2023 by the learned Extra Joint Additional Sessions Judge, Nanded. The learned counsel for applicant submitted that the fine amount of Rs.5,000/- is not deposited.

39 APPLN.1606.2024.odt Subject to depositing the fine amount of Rs.5000/- by the applicant in the Trial Court prior to releasing him on bail and considering the facts and circumstance of the case, the application can be allowed on certain conditions.

Considering the peculiar set of facts of the case, the execution of sentence awarded to the applicant is suspended till final decision of the revision application, subject to depositing the fine amount of Rs.5,000/- by the applicant in the Trial Court. If the fine amount is deposited then the applicant be released on bail on executing P. R. bond of Rs.15,000/- with one surety of the like amount. The bail bond shall be furnished before the Trial Court. The criminal application is disposed of.
