After hearing, it transpires that the order impugned has been passed taking into account that the main miscellaneous civil appeal had been dismissed for not taking steps. Under the circumstances, since the appeal was not surviving, impugned order has been passed. As such, no fault can be found with the order.

It appears to be the grievance of the petitioner that there is a grave danger posed, to amount with respect to land acquisition compensation lying in the court, by

WP-6243.15 present respondents. In such a case, petitioner may, in application seeking restoration of appeal, seek relief by making appropriate application.

Writ petition stands disposed of.
