This petition is rather premature.

The facts of this petition can be said in short as under:- The petitioner is a prisoner. In November 2009 he was granted Parole leave on the ground that his mother was not feeling well. The petitioner sought extension of parole leave. His applications seeking extension of parole leave are still pending. In the meantime, the petitioner surrendered on 17th February, 2010. He apparently over stayed for 60 days more. The authorities issued Show Cause Notice as to why he should not be punished for over staying.

The authorities are therefore directed to consider the petitioner's earlier applications seeking extension of parole leave on merits while deciding further action.

The learned Counsel appointed for petitioner shall be paid fees according to rules through Legal Aid.
